Outcome
Jury could not reach unanimity — favorable disposition
Our client was charged with illegal entry — a federal offense prosecuted in immigration courts where the government’s conviction rate is high and defendants often face significant consequences beyond the criminal charge itself.
We prepared and tried the case fully, presenting our client’s complete story to the jury. Federal juries in immigration cases are not guaranteed to be sympathetic, and the government came prepared. We challenged the government’s evidence and made sure the jury understood the full human context of our client’s situation.
The jury was unable to reach a unanimous verdict, resulting in a hung jury and a favorable disposition for our client.
In the federal system, where the government wins the vast majority of cases that go to trial, a hung jury is a significant victory. It reflects a defense that created genuine, reasonable doubt in the minds of multiple jurors.
